Classification and Valuation Issues for Texas Property Division

Typically, there are two overriding issues in every property distribution matter during a divorce. First, property must be classified as either marital or non-marital property. Only marital property is subject to division.

Second, marital property must be valuated, i.e., its worth must be determined.

Marital property is property accumulated during the marriage. Non-marital property is property brought into the marriage or received as a gift or inheritance during the marriage. The line between these two types of property becomes unclear when marital property is commingled with non-marital property. An example would be a home owned by one spouse prior to marriage where, during the marriage, payments are made on the mortgage or for renovations using marital assets. Other examples would be a retirement plan, pension or insurance policy owned prior to marriage where payments and contributions made during marriage increase the value of the asset.

Valuation issues can also present problems. For example, how do you value a business or professional practice where the income is dependent on the work of you or your spouse? What about minority shares in a close corporation? Insurance policies, pension plans and stock options? The family pet?
