Child custody has two parts: legal custody, which encompasses the ability to make decisions on behalf of a child, including those relating to medical care, education, and religious upbringing, and physical custody, which involves where the child primarily physically resides.

Typically, the court will award joint legal custody to allow both parents to make decisions, unless it can be shown that one parent would be detrimental to the child. Physical custody, however, involves convincing the judge that the primary residence of the child would be best served with one particular parent.
